Arranging letting agreements, deposit and rental
We draw up documentation and arrange signatures for the agreement between you and the tenants. To protect your interests, paperwork must be complete and the deposit plus first month’s rent received prior to the tenant moving in.The agreement we use is called an Assured Shorthold Tenancy.This means that under part 1 of the Housing Act 1998 you are entitled to repossession of your property.Your Letting Manager will give you a copy. Normally the Tenancy Agreement is for twelve months.
Length of tenancy, notice and deposit
Where the Landlord has instructed or accepted a breakclause, this normally provides, under Clause 10 of the Tenancy Agreement, a right for either the Landlord and/or the Tenant to terminate the Agreement after six months, but with two months notice period (eight months in total).This notice has to be served in writing to the other party. If there are any additional requirements and or variance from the standard agreement these will be listed in a Rider document and attached to the agreement.
Before the tenant signs the Tenancy Agreement, we normally take one month’s rent and one month’s security deposit from them. Once the Tenant has signed, we then arrange for you also to sign or, if by prior agreement, we sign on your behalf.

Property Condition

Recording property condition
On the agreed start date, the Tenants are handed a set of keys and we complete a Check-In schedule report with them at the property. It is prepared for the purposes of recording the general condition of the property at the commencement of the Tenancy.The Tenant would examine the Check-In report and sign to verify that they are in agreement with its contents.
At the end of the tenancy the report would be checked against the current condition of the property at the Check- Out. In some cases where the contents of a property warrant a more detailed report, we may recommend and refer a landlord to the services of an external Inventory specialist.
At the end of the tenancy
Towards the end of the Let, we will discuss with you whether you wish to renew the Tenancy or Relet the property and if so, on what terms.We will arrange the necessary formalities with you i.e. signing of new agreements and finding new tenants as required.
Return of deposit
At the end of the Tenancy, we arrange to compare the condition of the property against the Check-In report via a Check-Out or with the external inventory clerk if you had a specialist Inventory Report.The Landlord should use this final outgoing report to determine whether any deposit money from the Tenant should be retained against damage or replacement arising from the Tenant’s occupation.
